Homicide / Murder

Orange County Homicide & Murder Defense Attorney

Murder is a category of homicide and often gets lumped together when an individual is charged. It is the unlawful and deliberate killing of another individual. Murder is premeditated, meaning the action of taking another’s life was intentional either in the moment or thoughtfully planned out. If you have been charged with murder, you need to immediately hire a defense attorney that wholeheartedly believes “innocent until proven guilty.”

For obvious reasons, murder is heavily punished and typically has the steepest punishments in the entire legal system. If the accused does not have a masterful defense attorney on their side, they can get convicted and suffer the consequences of life in prison or even being sentenced to death. A wrongful conviction can literally take away an individual’s life.

The Difference Between First-Degree & Second-Degree Murder

First-Degree Murder – A killing that involves kidnapping, torture, taking the life of a prison guard or police officer, or as an additional offense committed during another crime (such as rape or armed robbery).

Second-Degree Murder – A killing without premeditation, as would be the case when an individual is killed during a bar fight, or in the heat of a passionate moment (ex. an argument)

Potential Defenses We Can Implement

Just because it is difficult to get absolved of murder charges does not mean it is impossible. There are certain strategies we can develop but it all depends on the individual case. Each one is unique and each one needs to be treated as such. There are a few defense techniques we can develop, such as:

  • Self-Defense
  • Mistaken Identity
  • An Unavoidable Accident
  • Insanity
